Mr. Gerber is a Member of Evans & Dixon, LLC and chairman of the firm’s Large Loss Subrogation practice group. Mr. Gerber has a reputation of being a tough trial lawyer, with extensive litigation and trial experience in the field of fire/explosion subrogation law. Mr. Gerber leads a team of lawyers he has trained over the years who likewise handle exclusively large loss subrogation cases, including product liability, fires, explosions, water losses, contract, environmental, railroad, transportation and construction matters. Two of Mr. Gerber’s recent accomplishments involve the devastating West, Texas fertilizer plant explosion which caused over $500,000,000 in damages, the Younkers Building high-rise fire in Des Moines, Iowa, involving over $60,000,000 in property damages and numerous other catastrophic fire and explosion cases causing hundreds of millions of dollars in losses.
Mr. Gerber has successfully tried
over 50 trials and has litigated and/or been involved in over 1,000 fire cases
throughout the country, from California to Florida, in both state and federal courts,
with jury verdicts and multimillion dollar settlements on losses involving
warehouse and manufacturing plant fires, chemical explosions/fires, fireplace
fires, restaurant/hotel fires, alarm cases, railcar disasters, electrical
distribution equipment, lumber facilities, security cases and other disasters
involving fire. Mr. Gerber has proven
organizational skills and has developed creative methods to handle complex site
investigation/spoliation issues where he is often given the role of lead
counsel on cases involving multiple subrogation claims stemming from a single
disaster. Mr. Gerber has unique experience in complex fire science and
engineering issues. From organizing joint site inspections to choosing and
coordinating the best experts, Mr. Gerber and his team will handle all aspects
of the subrogation case, from inception through trial.
“Our subrogation practice is aggressive. Any firm can win the easy, clear cut fire case. What separates us from other firms is we find creative ways to win the difficult cases. We don’t give up. We’ll look for subrogation opportunities on cases when others simply close the file. We fight for our clients and make subrogation easy for the adjuster. Our thoroughness and tenacity equates to top dollar recoveries”
Mr. Gerber has assembled a network of subrogation experts to establish a “rapid response” team for fires and other catastrophic losses throughout the country and he has personally attended hundreds of fire scene inspections to assure his client’s cases are built properly from inception.
Mr. Gerber is the Chairman for the Missouri-Kansas Chapter of the National Association of Subrogation Professionals and is often invited to speak nationally on subrogation, fire and explosion issues for the PLRB, NASP, International Association of Arson Investigators and other national organizations.
