In State ex rel Maloney v Allen, 26 S.W.3d 244 (Mo.App. 2000), the Court allowed protective order not to depose doctor or release psychiatrist’s records, did not reach issue whether records were discoverable but rejected employer’s contention that no privilege existed in records. The employer had sought psychiatric records to contest that claimant’s self-inflicted gun shot would was unrelated to accident 6 months earlier.
