In Bloss v Plastic Industries, 32 S.W.3d 666, (Mo.App. S.D. 2000), the Commission confirmed in finding that work related physical injury resulting in symptom magnification disorder is compensable, permanent total disability from both physical and mental injury sustained.
In Degraffenried (Deceased) v R.L. Hannah Trucking, (LIRC) 6/12/01. The deceased claimant suffered a stroke while setting in the cab of his truck. The Labor and Industrial Relations Commission in reversing the ALJ’s award and decision denying compensation held that driving longer than the law allows including maintaining two sets of driver’s logs concealed the amount of driving he was doing created the work related stress it was the substantial factor in causing claimant’s stroke. The Commission found the claimant was entitled to past benefits for permanent total disability, medical expenses and nursing services.
